United States v. Mitchell
In 2012, Marc represented a client charged in federal court with carrying a firearm during and in relation to a drug trafficking offense, felon in possession of a firearm and ammunition, and possession with intent to distribute cocaine. The government alleged that during a drug deal gone bad, a woman was shot, a man was shot and killed, and that client discharged a firearm, killing another man. For discharge of the firearm, the client faced a mandatory minimum of 10 years to life imprisonment, consecutive to (meaning in addition to) custody time imposed for possession with intent to distribute cocaine. Marc negotiated a resolution in which the government agreed to dismiss the mandatory minimum charge. At the sentencing hearing the government argued for 20 years, Marc responded that his client was a victim and hero that saved life, the Court imposed a sentence of 8 years.
